These Terms of Service govern your use of joinorbit.net and the services provided by Orbit Creative Solutions LLC ("Orbit", "we", "us"). By using the site or engaging us for a project, you agree to these terms.
Short version: we do the work we're hired to do, we bill honestly, we own the liability for our mistakes, and you own everything we deliver. For specifics, read on.
1. Acceptance of these terms
By accessing the site or engaging our services, you accept these terms in full. If you don't agree to any part, please stop using the site and don't engage us for a project.
2. Services we provide
Orbit Creative Solutions LLC offers web design and development services, including but not limited to:
- Website design and development (Launch, Growth, Custom tiers)
- Monthly Care Plans for hosting + maintenance
- Branding and visual identity
- SEO and content services
- Free tools (Website Audit, Resource downloads)
Specific scope for paid engagements is documented in a project proposal or statement of work signed by both parties before work begins.
3. Payment terms
- Launch ($2,500): 50% upfront to start, 50% on go-live.
- Growth ($9,500): 40% upfront, 30% at mid-point review, 30% on go-live.
- Custom ($15k+): milestone-based, scoped per project.
- Care Plans: billed monthly via Stripe, cancel anytime from the Stripe customer portal.
Invoices are payable within 14 days of issue. Late payments accrue 1.5% interest per month. We may pause work on your project if an invoice is more than 14 days overdue.
4. Ownership and intellectual property
Most Orbit engagements run on a subscription — we retain ownership of the source code and license you the use of it for as long as you're a subscriber. The Service Agreement has the complete ownership breakdown; the summary is:
- Subscription clients: Orbit retains source code ownership. You own your domain, all content and images you provide, all lead/customer data the site captures, and any branding we create for you. You can convert to full code ownership anytime via the Buyout option ($9,500).
- Ownership clients (one-time $9,500 tier, or post-buyout): you own the full source code repository and everything else listed above. You host it wherever you want.
- Regardless of tier: you always own your content, copy, images, and data.
We retain the right to:
- Reuse generic code patterns and our internal libraries in future projects
- Reference completed projects as case studies on our own marketing materials (unless you've signed an NDA)
- Maintain our own design process, tools, and methodologies
5. Revisions and scope
Each tier includes a specified number of revision rounds:
- Launch: 2 rounds
- Growth: 4 rounds
- Custom: scoped per engagement
Additional revisions beyond the included rounds are billed at $150/hour, quoted in advance.
Scope changes mid-project require a written change order and may affect timeline and pricing.
6. Timelines
We commit to published project timelines. Timeline starts when kickoff deposit clears and you've provided content and access to necessary accounts. Delays caused by missing content or unresponsive feedback extend the timeline day-for-day.
7. Cancellation and refunds
All fees paid to Orbit are non-refundable. This includes setup fees, monthly subscription fees, annual prepayments, and the one-time Ownership buyout fee. Cancellation terms below describe how each plan ends — they do not entitle you to a refund of fees already paid.
- Monthly subscription: cancel anytime. You remain on the service through the end of the then-current billing month, after which no further charges apply. Fees already paid for the current and prior months are not refunded.
- Annual subscription: annual prepayments are non-refundable. If you cancel before the end of the prepaid year, you retain access to the site through the end of the prepaid term, after which the engagement ends with no further charges and no refund of the unused portion.
- Ownership buyout: the one-time $9,500 buyout fee is non-refundable once the source-code repository has been transferred.
- Material breach by Orbit: the no-refunds policy does not bar your normal contract remedies if Orbit materially fails to perform and does not cure the breach within the cure period set out in your signed Service Agreement.
8. Warranty and support
Every project includes post-launch support (30 days for Launch, 90 days for Growth, scoped for Custom). During this window, we fix bugs in our delivered work at no charge.
Support does not include: content additions, new feature requests, third-party integration problems outside our delivered scope, or issues caused by changes you made to the code. Those are covered by Care Plans or billed hourly.
9. Liability
We take our work seriously and stand behind it. That said, our total liability for any engagement is limited to the fees paid for that engagement. We're not liable for:
- Lost profits or indirect business damages
- Third-party service outages (Vercel, Supabase, Stripe, etc.)
- Issues caused by changes you or third parties made to the delivered code
- Content errors from content you provided or approved
10. Confidentiality
We treat client information as confidential. We don't share your business data, strategy discussions, or pre-launch materials with third parties. NDAs are welcome and we'll sign yours or provide ours.
11. Dispute resolution
If a dispute arises, we agree to work it out in good faith first via direct conversation. If that fails, disputes are governed by the laws of the State of Minnesota and will be resolved in Hennepin County, Minnesota.
12. Acceptable use
You agree not to use our site or services for illegal activities, to harass others, to distribute malware, or to attempt to breach our security systems.
13. Changes to these terms
We may update these terms periodically. Material changes will be announced on the site. Your continued use after changes constitutes acceptance of the updated terms.
